Indiana appeals court hears case at RSHS
The Rising Sun High School auditorium became a courtroom recently, when the Indiana Court of Appeals heard oral arguments in Larry Ervin v. State of Indiana. The event was part of an “Appeals on Wheels” stop, and the court’s first visit to Ohio County.
The court’s goal is to visit all 92 Indiana counties with the Appeals on Wheels program, with 10 to go after the visit to RSHS. Panel members Judge John G. Baker, Monroe County, Judge L. Mark Bailey, Decatur County, and Judge Melissa S. May, Vanderburgh County, heard arguments presented by Victoria Bailey, appellant attorney, and Lyubov Gore, appellee attorney.
Ervin was appealing his convictions of Level 5 felony criminal recklessness and Level 6 felon pointing a firearm. The convictions stem from a Feb. 28, 2017, incident where Ervin attempted to make a citizens’ arrest of the person he believed stole his iPad two days earlier.
